Even as Mirena IUD lawsuits mount, more and more media outlets are touting the device as a first-line birth control choice even for teenage girls. Sadly much of this reporting fails to mention many of the complications that have led women to file Mirena lawsuits, including:

Infection, abscess

Tissue erosion

Infertility

Peritonitis

Intestinal perforation, obstruction

Pelvic inflammatory disease (PID)

Uterine perforation

Embedment of the device in the uterine wall

Ectopic pregnancy

Mirena and IUD Evangelism

One such report, recently published by NYMag.com, makes a big deal of so-called IUD evangelism women so happy with Mirena, that they convert their friends to the device. However, the article does not mention the dozens of Mirena IUD lawsuits that have been filed in courts throughout the country by women who suffered serious complications when the IUD spontaneously migrated from its proper placement in the uterus.

While there are likely many women who use Mirena and appreciate its convenience, there remains a growing contingent who have allegedly suffered serious and life-altering injuries. Women considering Mirena should be aware of the device s potential risks, but with no Mirena recall planned and one-sided view points, such as what was presented in the NYMag.com article, many women remain unaware of the potential risks associated with the Mirena IUD.

Mirena Lawsuit Allegations

Many Mirena lawsuits allege that Bayer minimized details on the risks of serious injuries associated with the IUD, such as spontaneous device migration, which can occur long after the Mirena had been implanted. Mirena plaintiffs also note that Bayer was cited in a 2009 U.S. Food & Drug Administration (FDA) warning letter for overstating Mirena s benefits and downplaying its potential side effects in a Bayer marketing program. Because of Bayer s alleged failure to adequately alert consumers about potential Mirena complications and its reticence to implement a Mirena recall, many women may have needlessly suffered complications that put their fertility and health at risk. As a result, some women claim they were unable to make fully informed decisions concerning the device.

Many more Mirena IUD lawsuit filings are expected, given that 2 million women in the United States use the device. The New Jersey Supreme Court rejected Bayer s request to centralize all Mirena personal injury claims filed in that state in one proceeding in Middlesex County Superior Court in September 2012. However, plaintiffs petitioned the Court to reconsider that decision in April 2013, saying they anticipated a large litigation. Meanwhile, individuals with Mirena claims pending in federal court petitioned the U.S. Judicial Panel on Multidistrict Litigation (JPML) to transfer all federally-filed Mirena claims to U.S. District Court, Northern District of Ohio, for pretrial proceedings.
